Portfolio Advisors was retained by a medium-sized sub-prime auto lender
(the Plaintiff) as lead expert to provide testimony regarding loan
servicing and to quantify damages they incurred in their case against
their large loan servicer. The loan servicer was hired by the Plaintiff
to re-underwrite and service its loans, and the servicer is accused of
failing to do so adequately.
As lead
expert, Boston Portfolio Advisors has the most substantial role in
trying to establish cause and effect. We reviewed 1633 loan files to
determine compliance with underwriting guidelines. We also reviewed
thousands of pages of deposition testimony to evaluate the conduct and
performance of the servicer in fulfilling their responsibilities of the
agreement between the servicer and the auto lender. Our years of
experience and expertise enabled us to testify on the servicer’s actions
in underwriting, servicing, and collecting the loans compared to
accepted industry practices regarding underwriting and loan servicing.
We quantified damages at over $130 million and the parties settled out
of court.
